These Terms and Conditions ("Terms") govern access to and use of the e-Zap Health mobile application (the “App”).
By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.
1. About the App
The App is owned and operated by e-Zap Health Ltd ("Company", "we", "us", or "our").
The App has been developed by Mia Studios Ltd, which acts solely as a data processor and provides technical development and infrastructure services.
e-Zap Health is designed as a personal health tracking and organisational tool that allows users to record and organise health-related information including symptoms, diagnoses, medications, surgeries, tests, scans, allergies, lifestyle information, wellbeing information, image records, and related notes.
The App also includes an optional AI-powered feature known as Pulse AI. Pulse AI is designed to help users organise selected user-entered health records into structured summaries, chronology observations, healthcare discussion points, and informational preparation material.
Pulse AI uses a structured app-generated payload and a secure backend process using Supabase Edge Function infrastructure and OpenAI API services. Pulse AI is user-initiated and is intended to support organisation and preparation only. It is not intended to diagnose, triage, treat, prescribe, or replace a qualified healthcare professional.
The App is not a medical device and is not regulated by the Medicines and Healthcare products Regulatory Agency (MHRA).
2. Eligibility
You must be at least 16 years of age to use the App.
By using the App, you confirm that you meet this age requirement.
3. Account Access and Authentication
Authentication Infrastructure:
Authentication services are supported by third-party providers including Supabase and email delivery services such as Resend.
These providers process email addresses and limited technical metadata solely for the purpose of authentication and system reliability.
Such providers do not access health data or image data stored within the App.
Where the App uses Supabase infrastructure for authentication and backend processing, Supabase may process limited technical data necessary to support authentication, secure request handling, fraud prevention, and operational reliability. Supabase is not used by the Company to store user health records as a central health database.
Access to the App requires verification through a one-time email authentication process.
Authentication services are provided by third-party infrastructure providers. Users must provide an email address to receive a secure access code.
Authentication data, including email addresses and technical metadata, may be processed by such providers for the purpose of secure login and fraud prevention.
Users are responsible for safeguarding their access credentials.
Certain optional App functionality, including Pulse AI, may additionally require intermittent session re-verification through one-time authentication codes in order to maintain secure authenticated access, enforce operational safeguards, support fair-use request limitations, maintain service integrity, reduce abuse, and protect backend AI-processing infrastructure.
Such session re-verification may occur periodically and separately from any locally stored device PIN or local App-access controls used within the App.
If access credentials are lost, access to the App and associated data may not be recoverable.
4. Personal Health Information
Additional Feature – Image Hub:
The App includes an optional Image Hub feature which allows users to upload image files from their device file storage.
The App:
Uploaded images, scans, and documents are not transmitted to OpenAI by the current version of the App and are not externally analysed through Pulse AI. Pulse AI currently processes structured health-record summaries generated by the App rather than uploaded image or document files.
- does NOT access the device camera in its current version
- allows the user to manually select images via the device’s system image selection interface (such as the device photo library)
- does not access, scan, or retrieve images without direct user action
The App does not access the user’s photo library in bulk, does not scan or analyse the contents of the photo library, and only receives access to the specific image or images explicitly selected by the user.
Images are stored locally on the user’s device and are not accessible to e-Zap Health Ltd.
Users acknowledge that uploaded images may contain personally identifiable information (including but not limited to names, addresses, NHS numbers, clinical documents, or prescription details).
The Company:
- does not request such information
- does not review, inspect, or moderate uploaded images
- does not process or analyse image content
- does not use images for AI, profiling, or analytics
Users are solely responsible for all content uploaded and are strongly advised to redact sensitive information before uploading.
Users may voluntarily enter personal health information into the App, including but not limited to:
symptoms
symptom diary entries
diagnoses
medications
surgeries or medical procedures
vaccinations
allergies
tests and scans
All health information is entered solely by the user and is intended for personal tracking and organisational purposes.
Health data is stored locally on the user’s device, except where the user actively initiates a Pulse AI request, in which case selected structured health-related summaries may be securely transmitted to third-party AI infrastructure solely for the purpose of generating the requested Pulse AI output.
Users are solely responsible for:
- the accuracy of data entered
- maintaining access to their device
- managing backups (if any)
The Company does not:
- access user health data
- store health data on its servers
- verify the accuracy of user-entered data
- use user health data for advertising or behavioural profiling
- use uploaded image content for AI, analytics, profiling, or model training
- intentionally transmit email addresses, usernames, uploaded images, uploaded documents, NHS numbers, insurance identifiers, device identifiers, authentication credentials, or raw PDF files to OpenAI as part of Pulse AI
The Company cannot recover health data if:
- the device is lost
- the App is deleted
- device storage is cleared
- the device becomes inaccessible
5. App Functionality and Outputs
Image Linking Functionality:
The App may allow users to link images stored within the Image Hub to specific health records (including symptoms, medications, and surgical history).
This functionality:
- operates entirely on-device
- does not transmit image data externally
- does not alter or process image content
The linking function is organisational only and fully controlled by the user.
The App provides tools for organising and summarising user-entered information.
Pulse AI provides optional AI-assisted organisational outputs based on selected structured health information generated from records entered by the user. Pulse AI may assist with chronology interpretation, healthcare journey summaries, discussion points, record-quality observations, and suggested questions for healthcare appointments.
Pulse AI outputs are intended to help users prepare for healthcare discussions. They do not constitute medical advice, diagnosis, treatment advice, emergency guidance, or clinical decision support.
All outputs generated by the App:
- are based on user-entered data and, where Pulse AI is used, AI-generated interpretation of selected structured summaries derived from that data
- may be incomplete, inaccurate, or outdated
- are provided for informational purposes only
Users must not rely on the App or its outputs for medical or clinical decision-making.
6. Artificial Intelligence and Automated Features
The App includes optional automated and AI-assisted features, including Pulse AI.
Pulse AI is designed to provide structured healthcare organisation and preparation support based on selected user-entered health records. It may generate summaries, chronology observations, healthcare discussion points, suggested appointment questions, record-quality prompts, and other informational outputs.
Pulse AI uses a structured processing pathway. The App prepares selected health-related information into a structured payload before sending it through Supabase Edge Function infrastructure to OpenAI API services for the limited purpose of generating the requested Pulse AI output.
Pulse AI is optional and user-initiated. AI processing is not performed automatically in the background and is not required for users to use the core record-keeping functions of the App.
The App is designed to minimise the transmission of directly identifiable information. The current version of Pulse AI is not intended to transmit email addresses, usernames, uploaded images, uploaded documents, NHS numbers, insurance identifiers, authentication credentials, device identifiers, or raw PDF files to OpenAI.
Pulse AI may process structured health-related summaries generated from user-entered records, including symptom summaries, chronology summaries, diagnosis summaries, medication summaries, tests and scans context, lifestyle-related context, and other selected health observations recorded by the user.
Free-text notes entered by users may contribute to summarised contextual information used within Pulse AI processing. Users must not include unnecessary directly identifiable information in free-text health entries if they do not wish such information to be reflected in app-generated summaries.
OpenAI API services are used as third-party AI infrastructure for Pulse AI processing. Supabase infrastructure is used to route the request securely and to protect the OpenAI API key from exposure in the App.
Pulse AI may additionally use authenticated session validation, request monitoring, fair-use controls, rate-limiting systems, abuse-prevention mechanisms, and limited usage-related operational metadata processing in connection with secure AI-service operation and platform integrity.
The Company reserves the right to introduce, modify, suspend, enforce, or adjust usage limits, request controls, authentication requirements, session-validation measures, operational safeguards, or access restrictions relating to Pulse AI at any time for operational, legal, commercial, reliability, abuse-prevention, security, infrastructure-protection, or service-management purposes.
At the time of writing, OpenAI states that API-submitted data is not used to train models by default. Users should nevertheless refer to the Privacy Policy for further information about third-party processing, retention, and data handling.
Users acknowledge that AI-generated outputs may be inaccurate, incomplete, outdated, misleading, or fail to identify relevant healthcare considerations. Outputs may vary over time and may be affected by the completeness, accuracy, and wording of the user-entered records.
Pulse AI is not a medical device, diagnostic tool, emergency triage system, clinical decision system, treatment recommendation tool, or substitute for qualified medical advice.
Users must not rely on Pulse AI or any automated output for diagnosis, treatment, urgent care decisions, medication decisions, or medical decision-making.
7. Medical Disclaimer
The App is provided as a health tracking and organisational tool only.
The App does not:
- provide medical diagnoses
- provide treatment recommendations
- replace consultation with qualified healthcare professionals
- provide emergency assessment or triage
- guarantee that all relevant health issues, risks, patterns, or concerns will be identified
- provide clinician-level review of a user’s health history
Users must seek advice from a qualified clinician for any medical concerns.
8. Emergency Situations
The App must not be used during medical emergencies.
Pulse AI must not be used to assess emergencies, urgent symptoms, acute deterioration, or situations requiring immediate medical attention.
If you believe you are experiencing a medical emergency, you should immediately contact emergency services.
In the United Kingdom, this includes contacting NHS 111 or 999 where appropriate.
9. Acceptable Use
Users agree not to:
- use the App for unlawful purposes
- upload harmful, abusive, or misleading content
- misuse automated or AI features, including by attempting to obtain diagnosis, treatment instructions, emergency triage, or unsafe medical guidance
- attempt to reverse engineer or modify the App
- interfere with the App’s operation or security
- attempt unauthorised access
- intentionally submit unlawful, abusive, misleading, or unsafe content through Pulse AI
- attempt to bypass, weaken, or manipulate AI safety restrictions or non-diagnostic safeguards
- use Pulse AI for another person’s health information unless lawfully entitled and authorised to do so
Violation may result in suspension or termination.
10. Fees and Payments
Certain features of the App may require payment.
One-Time Purchase:
Users may purchase access to the App and optional additional accounts.
Subscriptions:
Optional premium features may be offered via subscription.
Subscriptions may be cancelled at any time, subject to platform terms.
Refunds are subject to the policies of the relevant app store provider (e.g. Apple App Store or Google Play Store).
11. Intellectual Property
All intellectual property rights in the App are owned by e-Zap Health Ltd.
Users are granted a limited, non-exclusive, non-transferable licence for personal use only.
Users must not:
- copy
- distribute
- modify
- reverse engineer
- create derivative works
12. Availability
We do not guarantee uninterrupted or error-free operation.
Pulse AI depends on third-party infrastructure, including Supabase and OpenAI API services. AI functionality may be unavailable, delayed, rate-limited, interrupted, modified, or withdrawn due to network issues, third-party service availability, system maintenance, legal requirements, platform requirements, abuse prevention, or operational reasons.
Pulse AI access may additionally depend on successful authenticated session validation and operational verification checks. Failure to maintain a valid authenticated session, failure to complete verification processes, third-party authentication outages, delivery issues affecting verification codes, or security-related access restrictions may temporarily limit or prevent access to Pulse AI functionality.
The App may be modified, suspended, or discontinued at any time.
Compatibility with all devices or operating systems is not guaranteed.
13. Limitation of Liability
Additional Limitation – User Content:
The Company shall not be liable for any consequences arising from user-uploaded content, including images containing personal or sensitive information.
All responsibility for such content rests solely with the user.
Additional Limitation – Pulse AI and Automated Outputs:
To the fullest extent permitted by law, the Company shall not be liable for consequences arising from reliance on Pulse AI, automated summaries, AI-generated observations, chronology interpretations, discussion points, suggested questions, record-quality prompts, or any other automated output.
Users acknowledge that AI-generated outputs may be incomplete, inaccurate, outdated, or may fail to identify relevant healthcare matters. Users remain responsible for seeking advice from qualified healthcare professionals and for making healthcare decisions in consultation with appropriate clinicians.
To the fullest extent permitted by law, e-Zap Health Ltd shall not be liable for:
- medical decisions made by users
- reliance on App outputs, including Pulse AI outputs and other automated outputs
- inaccurate, incomplete, unavailable, delayed, or failed AI-generated outputs
- failure of Pulse AI to identify, prioritise, or correctly describe a healthcare matter
- loss of data
- Loss of profits or opportunity
- Indirect or consequential losses
- Technical issues or interruptions
- Authentication failures, session-expiry events, verification delays, request-limit enforcement, fair-use restrictions, access-control measures, or temporary Pulse AI access limitations
The App is provided “as is” without warranties of any kind.
Nothing in these Terms excludes liability where unlawful.
14. Suspension or Termination
We may suspend or terminate access if users breach these Terms or misuse the App.
15. App Store Platforms
The App may be distributed via third-party platforms.
Users must comply with platform terms.
Platform providers are not responsible for the App.
Platform providers are also not responsible for Pulse AI outputs, third-party AI infrastructure, or healthcare decisions made by users.
16. Privacy
Use of the App is governed by the Privacy Policy.
The Privacy Policy explains in more detail how Pulse AI, OpenAI API services, Supabase infrastructure, authentication providers, diagnostics providers, and email delivery providers may process information.
17. Changes to Terms
We may update these Terms at any time.
Continued use constitutes acceptance.
18. Governing Law
These Terms are governed by the laws of England and Wales.
Disputes are subject to the courts of England and Wales.
19. Entire Agreement
These Terms constitute the entire agreement between users and the Company.
20. Severability
If any provision is found invalid, the remaining provisions remain in effect.

22. Wipe Data Function
The App includes a “Wipe All Data” function which removes all locally stored health data and images from the user’s device.
Important limitation:
This function does NOT remove or sever the association between the user’s email address and third-party authentication providers (including Supabase and related services).
Full disassociation requires the use of a new email address and reinstallation of the App.
The Wipe All Data function removes locally stored App records from the device but does not necessarily delete historical third-party processing records that may already have been generated through authentication, email delivery, diagnostics, or prior Pulse AI requests. Users should refer to the Privacy Policy for more information about third-party retention and deletion rights.
End User License Agreement

This End User Licence Agreement (“EULA”) is a legal agreement between you (“you” or “User”) and e-Zap Healthcare Ltd (“e-Zap Health”, “Company”, “we”, “us”, or “our”) governing your download, installation, access to, and use of the e-Zap Health mobile application (the “App”).
By downloading, installing, accessing, or using the App, you agree to this EULA. If you do not agree, you must not use the App.

Subject to your compliance with this EULA, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download, install, and use the App on a device that you own or control, solely for your own personal, lawful, and non-commercial use.
This licence does not transfer ownership of the App or any intellectual property rights in the App to you.

• use the App in any unlawful, fraudulent, abusive, or harmful manner
• attempt to interfere with the App’s operation, security, or availability

The App is intended to support personal record-keeping, health awareness, and preparation for healthcare discussions.
The App is not provided as a clinical service, medical device, or emergency support tool.

5. No Medical Advice or Clinical Reliance
The App does not provide medical advice, diagnosis, treatment recommendations, or emergency care.
Any information, summaries, timelines, analytics, alerts, charts, or automated outputs available within the App are provided for general informational and organisational purposes only.
They may be incomplete, inaccurate, out of date, or unsuitable for your personal circumstances.
You must always seek advice from a qualified healthcare professional regarding symptoms, diagnosis, treatment, medication, or other medical decisions.
The App must not be relied upon as a substitute for professional medical judgment.

The App may include optional AI or automated analysis features, including features within “My AI”.
Where used, such features may generate summaries, insights, pattern observations, appointment-preparation material, or other outputs based on information entered by the user.
These features may utilise technology provided by third-party AI providers, including OpenAI.
You acknowledge that:
• AI and automated outputs may contain errors or omissions
• outputs may vary over time or between uses
• outputs may not reflect the latest medical guidance
• outputs are informational only and must not be treated as medical advice
Use of AI features is at your own discretion and risk.
AI-assisted functionality may additionally utilise authenticated backend infrastructure, session-validation systems, request-monitoring mechanisms, operational safeguards, fair-use controls, rate-limiting systems, and related security protections in order to support secure and sustainable operation of AI features.

7. User Data and User Responsibility
You are responsible for the information you choose to enter into the App and for the decisions you make based on that information.
You are also responsible for:
• maintaining the security of your device
• safeguarding your login credentials or access method
• checking the accuracy and completeness of information entered into the App
• maintaining your own backups where appropriate
Health data recorded in the App is intended to be stored locally on your device.
We do not guarantee recovery of data if your device is lost, damaged, reset, inaccessible, or if the App is deleted.

Access to the App may require an email authentication process or other security step.
You are responsible for ensuring the email address or device access method you use remains secure and accessible to you.
Certain optional functionality, including Pulse AI, may additionally require intermittent re-authentication, session validation, or other verification measures in order to maintain secure authenticated access, support operational safeguards, enforce fair-use limitations, protect AI-processing infrastructure, maintain service integrity, or reduce abuse.
We may update, suspend, restrict, or withdraw authentication or access methods where necessary for operational, technical, or security reasons.

9. Privacy and Data Handling
Your use of the App is also subject to the e-Zap Health Privacy Policy.
That policy explains how limited personal data may be processed in connection with authentication, app functionality, legal compliance, and related matters.
By using the App, you acknowledge that data may be handled in accordance with the Privacy Policy.

10. Payments, Subscriptions, and App Store Billing
Certain features or access rights within the App may require payment, including one-time purchases or optional subscription features.
Where subscriptions or in-app purchases are offered through Apple App Store or Google Play, billing, renewals, cancellations, and refund handling may also be subject to the terms and processes of the relevant platform provider.
Unless otherwise stated by applicable law, platform rules, or our own stated policy, purchases may be non-refundable once access has been granted or authentication credentials have been issued.

11. App Store Terms
If you download the App from Apple App Store, Google Play Store, or another third-party distribution platform:
• this EULA is between you and e-Zap Healthcare Ltd, not the platform provider
• the platform provider is not responsible for the App’s maintenance, support, or content
• the platform provider is not responsible for any claims relating to the App, including legal, regulatory, or health-related claims
• you must also comply with the applicable terms of the relevant app store or platform
Where required by a platform’s standard terms, that platform may have the benefit of certain provisions of this EULA as a third-party beneficiary.

12. Updates and Changes
We may issue updates, upgrades, patches, fixes, or changes to the App from time to time.
We may also amend or remove features, suspend parts of the App, or discontinue the App entirely.
We are not obliged to continue making any version of the App available indefinitely.
This may include modifying authentication requirements, AI operational safeguards, request limitations, access controls, session-validation requirements, backend protections, safety constraints, or AI-related functionality associated with Pulse AI or other automated features.
Continued use of the App after updates or amendments may constitute acceptance of the revised version where permitted by law.

13. Suspension and Termination
This EULA remains in effect unless and until terminated.
We may suspend, restrict, or terminate your right to use the App if:
• you breach this EULA
• you misuse the App
• continued access presents a legal, technical, or security risk
• the App or a relevant service is discontinued
On termination, your right to use the App ends immediately and you must cease use of the App.

14. Disclaimer of Warranties
To the fullest extent permitted by law, the App is provided on an “as is” and “as available” basis.
We do not guarantee that the App will be uninterrupted, error-free, secure, compatible with every device, or suitable for your particular requirements.
All warranties, representations, and conditions not expressly stated in this EULA are excluded to the maximum extent permitted by law.

15. Limitation of Liability
To the fullest extent permitted by law, e-Zap Healthcare Ltd shall not be liable for:
• medical or health-related decisions made by you or any other person
• reliance on outputs, summaries, charts, insights, or other information generated within the App
• loss of data, loss of access, corruption of records, or failure to back up data
• device issues, software conflicts, downtime, or service interruption
• any indirect, incidental, special, consequential, or punitive loss or damage
Nothing in this EULA excludes or limits liability where such exclusion or limitation would be unlawful, including liability for fraud or for death or personal injury caused by negligence where applicable.

16. Emergency Use Restriction
The App must not be used in a medical emergency.
If you believe that you or another person may require urgent medical attention, you should seek immediate assistance from the appropriate emergency or urgent care service.
In the United Kingdom, this may include contacting NHS 111 or 999, depending on the circumstances.

17. Governing Law and Jurisdiction
This EULA and any dispute or claim arising out of or in connection with it shall be governed by the laws of England and Wales.
The courts of England and Wales shall have jurisdiction, except where mandatory consumer law in another part of the United Kingdom gives you the right to bring proceedings there.

Where Pulse AI is used, selected structured healthcare summaries derived from user-entered records may be temporarily processed through OpenAI API infrastructure solely for the purpose of generating the requested Pulse AI output.
Authentication and secure backend infrastructure may utilise providers including Supabase and Resend.
Users should review the Privacy Policy carefully for further details regarding Pulse AI, OpenAI processing, Supabase infrastructure, authentication processing, local data storage, and image handling.

3. AI-Generated Information
